1. Acceptance of Terms

By downloading, installing, or using Pawtograph ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and CurlyCorn LLC.

2. Description of Service

Pawtograph is a pet photo editor application that uses artificial intelligence to transform pet photos. The service includes:

•AI-powered photo transformations
•250+ themes and templates
•Photo saving and sharing capabilities
•Shareable digital cards hosted at unique links on our website
•Creative mode for custom transformations
•High-resolution image upscaling

3. User Accounts & Responsibilities

You are responsible for:

•Providing accurate information when using the App
•Maintaining the security of your device and app data
•All activities that occur under your use of the App
•Complying with all applicable laws and regulations

4. Acceptable Use

You agree NOT to:

✗Upload inappropriate, offensive, or illegal content
✗Use the App to harass, abuse, or harm others
✗Attempt to reverse engineer or hack the App
✗Violate any intellectual property rights
✗Upload photos of people without their consent

5. Intellectual Property

Your Content

You retain all rights to the photos you upload. By using the App, you grant us a limited, non-exclusive license to process your photos solely for the purpose of providing the service.

Our Content

The App, including its design, features, and content (excluding user content), is owned by CurlyCorn LLC and is protected by copyright, trademark, and other intellectual property laws.

6. User-Generated Content, Shared Cards & Copyright (DMCA)

6.1 Shared Cards Are User-Generated Content

The App allows you to share a generated image as a digital card hosted on our website at a unique link. Shared cards, including the image and any names or messages you enter, are user-generated content. Anyone with the link can view a shared card. You are solely responsible for the content you share and for whom you share it with.

6.2 Your Responsibilities & License to Us

By sharing a card, you represent and warrant that you own or have the necessary rights to the underlying photo and any text you include, and that the shared content does not infringe any copyright, trademark, privacy, or publicity rights of any third party and is not unlawful, obscene, hateful, or harassing. You grant CurlyCorn LLC a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and publicly display the shared content solely for the purpose of operating the card-sharing feature.

We do not review shared cards before they are published. We may remove or disable access to any shared card at any time, at our sole discretion, without notice. Every card page includes a link to report content that violates these Terms.

6.3 Copyright Complaints (DMCA)

We respect the intellectual property rights of others and respond to notices submitted under the Digital Millennium Copyright Act (DMCA). If you believe content hosted on our website infringes your copyright, send a notice to hi@pawtograph.app with the subject line "DMCA Notice" that includes:

•Identification of the copyrighted work you claim has been infringed
•The URL of the material you claim is infringing (e.g. the card link)
•Your name, address, telephone number, and email address
•A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
•A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf
•Your physical or electronic signature

Upon receipt of a valid notice, we will remove or disable access to the allegedly infringing material expeditiously. If you believe your content was removed by mistake or misidentification, you may submit a counter-notice to the same address containing the information required by 17 U.S.C. § 512(g)(3). We will terminate the sharing privileges of users who are repeat infringers.

7. Data Retention

Photos and generated images are temporarily stored on our servers and automatically deleted after 1 day. Images you choose to share as a card, together with the card details you enter (such as a recipient name and message), are stored for as long as the card remains available so that recipients can view it (see Section 6). Photos sent to our AI processing providers (fal.ai, Google Gemini, and Replicate) may be retained according to their respective data retention policies. Please refer to each provider's privacy policy for more information about their data handling practices.

8. Subscriptions, Credits & Payments

8.1 Subscription Required

Pawtograph requires an active subscription to use any features. All photo generation and editing capabilities are available exclusively to subscribers.

8.2 Subscription Plans

We offer two subscription options:

•Weekly Subscription: Renews every 7 days
•Annual Subscription: Renews every 365 days (better value)

8.3 Credit System

Each photo generation or upscale operation consumes one (1) credit. Your subscription includes the following credits:

Weekly Credit Allocation:

•40 credits per week (resets 7 days from your subscription start)
•Weekly credits do NOT roll over to the next week
•Unused weekly credits expire when the week resets

Annual Credit Cap & Regeneration Mode:

•Maximum 800 credits can be used per year
•After using 800 credits in a year, you enter "Regeneration Mode"
•In Regeneration Mode: Only 5 credits per week (instead of 40)
•Annual cap resets 365 days from your subscription start

Credit Reset Schedule:

•Credits reset based on YOUR subscription start date, not calendar dates
•Weekly reset: Every 7 days from subscription start
•Yearly reset: Every 365 days from subscription start

8.4 One-Time Credit Purchases

Active subscribers can purchase additional credits when needed. We offer various credit packages:

•25 credits (smallest package)
•60 credits (medium package)
•150 credits (large package)
•400 credits (best value package)

Pricing varies by region and currency. Current prices are displayed in the app. Important notes about one-time credits:

•One-time credits NEVER expire
•Only used after your subscription credits are exhausted
•Can only be purchased and used by active subscribers
•Remain in your account even if subscription lapses

8.5 Payment Terms

•Payment will be charged to your App Store or Google Play account upon confirmation
•Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date
•Renewal charges occur within 24 hours before the end of the current period
•You can manage and cancel subscriptions in your device's App Store or Google Play settings
•No refunds for partial subscription periods or unused credits
•Free trial periods, if offered, automatically convert to paid subscriptions unless cancelled

8.6 Price Changes

We reserve the right to change subscription prices. Existing subscribers will be notified of price changes at least 30 days in advance. Your continued subscription after a price change constitutes acceptance of the new price.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE APP IS AT YOUR OWN RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CURLYCORN LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE PAST TWELVE MONTHS.

11. Indemnification

You agree to indemnify and hold harmless CurlyCorn LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

12. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for any reason, including violation of these Terms. Upon termination, your right to use the App will immediately cease.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law principles.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes through the App or by email. Your continued use of the App after changes constitutes acceptance of the modified Terms.
